1. What Data Do We Collect?

Summary:  There are two types of data that is collected from you:

a) information that you voluntarily provide to us such as your email address or payment details; and

b) information that is automatically collected such as cookies or IP (Internet Protocol) address.

a) Information you voluntarily provide to us

We collect personal information that you voluntarily provide to us when registering on our website, filling out a contact form, expressing an interest in obtaining information about us or our products and services, when participating in activities on the website (such as posting messages or entering competitions or giveaways), or otherwise contacting us.

  • Passwords and security data: Passwords, password hints, or similar security information used for authentication and account access.
  • Payment information: We collect data only necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions.
  • Other personal information: In the context of a coaching call, conversation, workbook, exercise, email, WhatsApp, or any other form of communication where you share personal details about yourself, work details, family situation, challenges you may be facing, or any other personal information.

You agree that all personal information that you provide to us is true, complete and accurate, and that you will notify us of any changes to such personal information. 

b) Information that is automatically collected

When you visit, use or navigate our website, some of your technical data is automatically collected.

  • IP address and other similar information: Although this information does not reveal your specific identity (like your name or contact information), it may include device and usage information, such as your IP (Internet Protocol) address, browser and device characteristics, operating system, language preferences, referring URLs (Uniform Resource Locator), device name, country, location, information about how and when you use our website and other technical information.  This information is primarily required to maintain the security and operation of our website, and for our internal analytics and reporting purposes.

2. How Do We Collect Your Data?

Summary:  We collect your data from the information you provide to us directly when you register or actively tell us information or through cookies. Sometimes, we may also receive information about you indirectly from social media or referral sources.

As discussed in #1 “What Data Do We Collect?” above, you directly provide us with your information when you:

  • Register online or place an order for any of our products or services.
  • Voluntarily complete a customer survey or provide feedback on any of our message boards or via email.
  • Contact us through our website, email, social media, or other means of communication.

  • Provide Services: We use your data to provide coaching and related services to our clients, potential clients, and website visitors. This includes calling, emailing, or otherwise contacting you, and using your personal information to help support your needs.
  • Order Fulfillment: To fulfill and manage your orders of our products or services, or for other contractual reasons. We may use your information to fulfill and manage your orders, payments, returns, and exchanges made.
  • Marketing: To send you marketing, advertising, and promotional communications. We or our third party marketing partners may use the personal information you send to us for our marketing purposes, if you have consented to receive such marketing information.   • Free gifts: We may use your information to administer competitions when you elect to participate in competitions or partake in the ability to win free coaching or other gifts.
  • Admin: For administrative reasons like sending you product, service and information, or changes to our terms, conditions, and policies.
  • Testimonials: We post client testimonials on our website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name, photo, job title, and testimonial. If you wish to update or remove your testimonial at any time, please contact us at info@kskycoaching.com.
  • Feedback: To request feedback so that we can improve our business processes and services.
  • Web Security: To protect our website to keep it safe and secure, e.g. for fraud monitoring and prevention.
  • Policy Enforcement: To enforce our terms, conditions and policies.
  • Legal Reasons: If we receive a subpoena or other legal request, or in order to comply with any legal requirements, we may need to use the data we hold to determine how to respond to such legal requests or to otherwise prevent harm to you or to others.
  • Business purposes: We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate or improve our website, products, services, marketing, and user experience to help serve our clients better.  This also includes our professional obligations such as keeping track of coaching hours in a logbook for the purpose of getting certified by or renewing our certifications with the International Coaching Federation (ICF) or sharing certain topics anonymously and hypothetically with other coaching professionals to better support our clients or for training or consultation purposes.

4. How May Your Data Be Shared?

Summary: We will share your data only with your consent, to fulfill business obligations, where required to comply with laws.

  • Reasonably Necessary Reasons: If we reasonably believe it is necessary to investigate, prevent, or take action for these potential situations: possible threats to the safety of any person, violations of our policies, illegal activities, or as evidence in litigation in which we may be involved.
  • Our Third-Party Service Providers: To third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to perform marketing, payment processing, data analysis, email delivery, hosting services, customer service, and any other related activities. This may involve the use of tracking technology on our website to collect data about how you interact with the website to help us better understand online activity. We do not disclose, sell, rent, or otherwise provide any of your information to third parties for their marketing or promotional purposes. 
  • For Professional Reasons: As part of our professional reporting requirements, we may have to report our client information for our coaching logs to our professional regulatory authority the International Coaching Federation (ICF). You can read about our professional ethics code here: https://coachfederation.org/code-of-ethics.    Should we require consultation to better support our clients or for training or consultation purposes, certain topics may be anonymously and hypothetically shared with other coaching professionals.
  • Business Partners: We may share your information with our business partners to offer you certain products, services or promotions. You can opt-out of our marketing emails at any time by emailing info@kskycoaching.com. 
  • Third-Party Advertisers: We may use third-party advertising companies that post ads when you visit our websites. These companies may use information about your visits to our website and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you. Please see #8 “How We Use Cookies” below for more information. 
  • Business Transfers: In the event of any negotiations of a merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company, we may share your information with these potential partners. 
  • With Consent: If we have your explicit consent, we may disclose your personal information for other purposes which we will inform you of at the time we receive your consent.

5. How Do We Store And Keep Your Data Safe?

Summary: We use our commercially reasonable efforts to store your information securely in Dubai, United Arab Emirates.  In some cases, your data may be transferred to third party providers in other countries for purposes that we have explained in this Privacy Policy.

We securely store your data through locked physical premises and password protected electronic files.

While we use commercially reasonable measures to protect the security of your personal information, please remember that we cannot guarantee that any measure is 100% secure.

Transmission of your data to and from our website or servers to yours is at your own risk. As the Internet is not 100% secure, you should only access the services within a secure environment.

Our servers are located in Dubai, United Arab Emirates (UAE). If you are accessing our website from outside the UAE, please note that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information.  Please see #4 “How May Your Data Be Shared?” above.

While these countries may not have data protection or other laws as comprehensive as those in your country, we will use our commercial reasonable efforts to take necessary measures to protect your personal information in accordance with this Privacy Policy.

 

6. How Long Do We Keep Your Data?

Summary: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy unless it is otherwise required by law or our professional requirements.

We will keep your personal information for as long as it is needed for the purposes for which it was collected or for other business or legal reasons, for example, to comply with legislation for corporate, tax, and other laws or related purposes.

  • Client Data: We will retain relevant personal information of our clients for at least six years from the date of our last interaction with that client in compliance with our regulatory obligations or other professional requirements. Clients include pro bono and potential clients for whom we may have performed our services without charge.
  • Website Visitors: We will retain relevant personal information of our website visitors (who are not clients) for at least three years from the date of our last interaction with that visitor in compliance with our regulatory obligations or other professional requirements.

When we have no ongoing legitimate business need to process your personal information or when the above time periods have expired, we may then, without further notice or liability to you, either:

a) delete your data by shredding any paper/physical copies and deleting electronic files; or

b) anonymize your data. Anonymizing your data means removing any personal details from the information so that you cannot be personally identified from it. It might include aggregating your data with other people’s (grouped together so you can’t be personally identified from it) or otherwise strip your data of all personally identifying characteristics.
